Welcome to ZooberiM (“Company,” “we,” “us,” or “our”). By accessing our website and using our automated call-handling and appointment-booking services (the “Service”), you agree to be bound by the following Terms of Service.

1. Nature of Service

ZooberiM provides an automated communication platform designed to answer inbound calls, qualify leads, and schedule appointments on behalf of your business. You acknowledge that the "agent" interacting with your customers is an automated system and not a live human employee.

2. Account Responsibilities

To use our Service, you must provide accurate business information, including service types, pricing, and calendar access. You are responsible for:

Maintaining the confidentiality of your account credentials.

Ensuring your linked calendars (Google, Outlook, etc.) are up to date to prevent scheduling conflicts.

The accuracy of the information provided to the automated agent for caller interactions.

3. Call Recording & Consent

By using this Service, you understand and agree that:

Recording: Calls handled by the Service are recorded and transcribed for quality assurance and record-keeping.

Compliance: You are responsible for ensuring that your use of call recording complies with the laws of your jurisdiction (e.g., "One-Party" vs. "All-Party" consent laws).

Disclosure: Where required by law, you must ensure the automated agent provides the necessary "this call may be recorded" disclosure to callers.

4. Appointment Booking & Liability

While our system is designed for high accuracy, ZooberiM does not guarantee that every interaction will result in a booked appointment or that every booked appointment will result in revenue.

We are not liable for lost revenue resulting from technical outages, caller hang-ups, or scheduling errors.

You retain final responsibility for confirming appointments and providing services to your customers.

5. Payment & Subscription

Billing: Services are billed on a recurring monthly basis.

No Long-Term Contracts: Unless otherwise agreed in writing, our service is month-to-month.

Cancellations: You may cancel your subscription at any time. Cancellations will take effect at the end of the current billing cycle. No pro-rated refunds are provided for partial months.

6. Data Privacy & Security

We value your data. We implement industry-standard encryption to protect call recordings and customer information. We will never sell your customer data to third parties. Our full data practices are outlined in our Privacy Policy.

7. Prohibited Use

You agree not to use the Service for:

Illegal telemarketing or "spam" operations.

Harassment or fraudulent activities.

Interactions that violate the Telephone Consumer Protection Act (TCPA) or similar international regulations.

8. Limitation of Liability

To the maximum extent permitted by law, ZooberiM shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising out of your use or inability to use the Service.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes via the email associated with your account. Continued use of the Service after changes constitutes acceptance of the new terms.
